WANTED - ONE ATTORNEY


According to Tom "Boss" Wade, Corporation Counsel Ian Silverman will not be returning as the city's chief lawyer.

Silverman has been Mayor Rosamilia's only Corporation Counsel. Prior to accepting the Corporation Counsel position Silverman had been an assistant district attorney under Richard McNally. He started his career with a cup of coffee at Bois, Schiller.

Silverman broke from some of his predecessors, namely David Mitchell, for refusing to act as a hatchet man. He was not combative by nature and not a strong presence in city hall. He seemed to get the job done, although the learning curve was initially steep.

In September 2014, Silverman lost the Democratic primary for the new City Court position to "democrat" Keith Gorman, by 23 votes. Gorman went on to face Republican Jill Kehn in the general election. It was a veritable who's that of the legal world. Kehn, who practiced without a license for over five years, would go on to win.

We don't know Silverman's plans but wish him well. There is a recent opening at the Appellate Division Third Department?

Now, the rumors will swirl about Silverman's successor. Traditionally, the Democrats have generally had better attorneys than the Republicans. The best, however, tend to advise from the sidelines and are too successful to hop into the game with both feet. Madden does not have to choose a Troy resident. He can chose an attorney that lives in the county. We think he should give Pat Morphy a call. Or Tom Hagen. If Madden chooses a confidant as his deputy, he'll need one insider that knows government, the players and how to avoid the landmines.

Chances are, it'll be someone we're not even thinking of.

THE NEW ECONOMY

Welcome to the future. This is the new economy. It won't be kind to those that depend on the old economy but it will allow creative and hardworking people to flourish. Grow the tax base, get property taxes down and work on the school district's reputation and Troy could do well.

Silverman is a gentleman and will have no problem finding employment or greener pastures. Dunne on the other hand is unemployable.

It's a net plus for the city. Getting someone in there with experience who can rely less on outside firms is a money saver.

Here's a question for all you legal eagles. Madden a lawyer hires Kevin G as deputy mayor another lawyer. They keep a " bad seed" with a checkered past on in city employment. This employee displays actions from his past that result in charges brought against him. Thus opening the flood gates from past and or current employees and people doing business with the city. With there legal backgrounds does this elevate a lawsuit settlement. Kinda like a Bill Cosby situation. What's the city liability?

If I understand your question: a employer can be held liable for negligent hiring, retention and/or supervision of an employee if they have notice of an employees behavior. Notice cannot be based on unfounded rumor or rumors propagated by political enemies. However if the same conduct was occurred elsewhere and the current employer knew about it, it could be the basis for at least the notice element of negligence.

It's a good thing no one like that works at city hall. Unless you have more than rumors to share.

A councilman is not an employee of the City. He is an elected official. They are different for purposes of this analysis. If you're worried about people at the county building maybe you should speak up.

Kathy Jimino asked the republicans to cross party lines and vote for her brother now will she cross party lines and demand a new Economic Development Director for the city of Troy from her brother? I believe they call that a quid pro quo. We held up our end Kathy now deliver for us.

It happens Mitch. You don't work for the state or an authority. I live the fact that there is actual evidence against Gordon and Crist but you fixate on Dunne. No one has told anyone what he did. We have an affidavit about Crist and Mrs. Gordon's own words. Any comment? Keep voting Republican. They seem like your kind of people. Hypocrites.

Vespasian here; and I would like to comment on Democratus' post about the new economy. I believe the reference to the incubator was a great shout-out to an idea that has proven successful in other markets, and is more in line with how new businesses are started and opportunities are identified and followed.

Let's do a bit of a SWOT analysis:

First, to the strengths. In my day, it took family lineage, lots of money and at least a legion of Rome's best to get anything done. An incubator creates a low-cost environment for ideas, with a little money, to be turned into concepts. In addition, the multiple start-up environment allows for creative thinking from one to infect the other (make sure there is plenty of penicillin handy).

Second, to weaknesses. Incubators do not guaranty success; nor do they guaranty a boost in the economy. They should be thought of more like aqueducts and roads. Back in my day, it was the aqueducts roads that made Rome what it was. . . well. . . that and a completely bad-ass military that we weren't afraid to use (see my comment regarding the conquest of Latham for more on that).

Now to opportunities. They exist; they just remain hidden. Hidden beneath the aged infrastructure of the way things are there exists tremendous creative energy and potential waiting to be unleashed and then purchased by corporate America. I would have just taken it, but these days modern emperors, like Bill Gates, have to actually provide fair value - which makes them kind of wimps in my book.

Finally, threats. I would not say that an incubator helps against the threat of invasion from Menands, but even in my day economic threats were very real. While it has taken me many centuries to accept this notion, allowing for entrepreneurs to make a go of it for themselves creates economic opportunity for others. And success breads success - there is a reason Detroit is motor city and San Jose is Silicon Valley; related businesses tend to aggregate near each other physically. Accordingly, success can make Troy more attractive for other similar businesses; economic success attracts economic success; and aggregation helps when organizing orgies as well.
