VOTER FRAUD ROCKS TROY

Ernest Everett, who sought and lost the Democratic nomination for mayor, has been charged with forgery and filing a false instrument. Everett is also being sued by former councilman John Brown for failure to pay royalties.

District Attorney Joel Abelove announced: "We have checked the voter registration cards and Mr. Everett is not a registered Republican. Therefore, I have the authority to prosecute this matter."

Why is it always people of color with the voter fraud? First John Brown, now Ernest Everett.

Its too bad he has been charged and it will be too bad if he did it. He seems like a fine young man and it is such a waste if he stooped to crime. Especially this. Frankly, it's just not a cool crime. Bank robbery with a daring get-away; a DB Cooper-style sky-jacking, where he parachutes out the back of the plane into a cold, dark night and then....he's gone. How does one explain this crime in prison:

EE: Uhm, filing a false instrument! That's right, how you like me now!

As always, the vultures are circling. And who is the first to deny Everett the presumption of innocence, the presumption we'd all like? You got it. Republican Jim Gordon. No, wait a minute. We got that wrong. It's Patrick Madden, the Democratic...no. Wrong again.

The Working Families Party candidate for Mayor, Rodney Wiltshire had this to say just hours after the charges were brought:

I'm saddened, but not surprised, to read with the rest of my fellow Trojans how desperate Tom Wade and the Democratic machine are to hold on to power. Troy doesn't need the embarrassment of yet more felony voter fraud. It's time we move beyond this, as myself and my supporters and voters have been saying.

Voters were deprived of a true primary when a candidate who had clearly submitted fraudulent signatures was allowed to remain on the ballot.* Now, sadly, rather than simply being off the ballot, a young person with a promising future caught up in this machine has a warrant out for his arrest.
Elections have real consequences, and Trojans are sick and tired of theirs being rigged. The BOE owes voters an honest explanation of why, after being presented with hundreds of incorrect ballot signatures, many obviously fraudulent, they refused to do their job and enforce the rules.**
The Madden/Everett campaign have been explicit in their mutual support, and its obvious that Madden is a 'Wade Democrat.'*** Tom Wade himself said that Madden never would have won the election without Ernest.****

The choice on November 3rd is now crystal clear.***** It's time to end crony politics once and for all so we can focus on the very real challenges our city faces. My campaign has always put honesty, hard work and integrity****** above all and If elected my administration will be ethical, transparent and work for a better Troy for all of us.

That is the Working Families Party candidate. The party of social and criminal justice, criminal and judicial reform. The party that fights to strengthen the rights of the accused.

We get pissed at Rodney because there is a lot of promise there. It just hasn't been fulfilled at this time. He has tried and convicted Ernest Everett based on an allegation. He has implicated Patrick Madden and Tom Wade based on what? Mere hope? He stumbled over himself to deny Mr. Everett the presumption of innocence to try and score political points. It disappoints us because this tactic has the Tutunjian stink all over it. This is what Tutunjian and his thugs would do. Gordon (Jesus Christ, can't believe we said that) and Madden have treated this matter with respect and appear willing to let the criminal justice system kick in. Everett may be guilty. So be it. Maybe not. So be it.

God forbid anyone that reads this, Republican, Democrat or blank is charged with a crime or even non-criminal wrongdoing. Do we want the mayor issuing a statement that pre-judges us? Is that mature, thoughtful, responsible leadership? Damn, Rodney. Your not supposed to act like a twitterer (twitite? twitteronian?), a blogger, Record reporter or just an average Joe.******* You have a responsibility to treat the rights of the accused and the criminal justice system with respect, not as political sport. You need to walk this back.

If you are accusing Patrick Madden of being an accomplice to a crime do it. Not in vague, wishy-washy political statements made on facebook. Hold a press conference, bring your proof, file a criminal complaint with the police. Right. Didn't think so. Just another politician.

That brings us to our next point. Gordon may be mayor because the Democratic vote will be split. We believe Gordon should not be mayor. We believe he would lose if he faced Madden or Wiltshire one-on-one. But, Madden can't drop out. The Democrats have to run someone on their line. A major party cannot sit the election out and hand things over to a minor party. They have to have people pulling the actual, Democratic lever (OK, fill out the Democratic bubble).

Rodney, you ran a great primary race. Well-organized and enthusiastic. There are problems with the system. They can be changed but you need a seat at the table to do that. If you stay in the race, Gordon will win and there won't be a table to sit at anymore.

As an aside, Everett's campaign handlers were out of Albany with links to the Brown family. Tom Wade did not run Everett's campaign. Tom Wade encouraged Everett to run for a council seat. Everett insisted on the mayoral race. Why wouldn't those who support Madden want Everett in the race? Do you think that Rodney wouldn't have loved it if a more establishment-type Democrat siphoned votes from Madden. Or is Rodney somehow entitled to face only one opponent in his races? Any other special rules we need to know about, Rodney? Tom Wade isn't perfect but he's not Keyser Soze. If he was, you would have lost by more than 50 votes.

** The Commissioners are supposed to know Everett wasn't a witness to the signatures and then unilaterally toss him off the ballot? Either you don't know the rules or don't care about them.

Rodney Wiltshire, the self-proclaimed "I'm not your house nigger" champion of minorities, civil rights, and the presumption of innocence over too-quick arrests, throws a fellow African American under the bus when it suits his megalomaniac purposes. Is anyone surprised? This hypocritical phoniness and pathological dishonesty is why the Dems never wanted him to be begin with. The stink of desperation is strong.

And yes, Rodney fucked up the petition challenges. He screamed and yelled from the beginning that Everett's signatures were bogus and he had full opportunity to pursue that in court. Witnesses could be produced, sworn testimony could be taken, and if true, all the offending petitions would be tossed. What happened? He missed the deadline. Blew right through it. Treated it like... well, a budget vote.

Is this the man we want as our leader? Of course not. That's why he lost the primary, and that's why he'll lose the general. Back to the sandbox, Rodney. You have a lot of growing up to do.

Let's get this straight : Rodney feels he's entitled to a two-way primary, and any third candidate running must be corrupt and in the pocket of the Democratic machine. I guess Rodney feels Everett should have dropped out to give Rodney a better chance of winning the primary. Wow, talk about voter disenfranchisement! Rodney's promoting it, right there. And I'm doubled over laughing at his claim that poor Everett (notice Rodney suddenly thinks he's a fine young man worthy of concern-- but only in this part) should have simply been thrown off the ballot instead of face criminal charges. Oh really, Rod? If a guy commits election fraud, it's ok to get away with it as long as it benefits you? Really high ethical principles you have there. You need to stop now, you're seriously embarrassing yourself.

Rodney's go-to tactic is consistently smarmy innuendo and conspiracy theory. (the puppet mailer anyone?). His next announcement will be that Wade or Madden shape shifted and actually were the light skinned black woman who allegedly got the signatures that Ernest allegedly did not witness. There is a system in place to challenge petitions and Rodney screwed up because he didn't file in time. The system didn't fail, Rodney just couldn't get his shit together.

Hmmmm. Everett made his decision to run known in February (see TU). The Dems interviewed candidates in April. Madden announced in June as the endorsed candidate. Ernest was in the race long before the Dem committee voted on who to endorse. So they preemptively recruited Ernest to run just in case Madden was the candidate? Rodney and Team Troy could have made a play at the Dem committee vote, but they said not a word, sat like bumps on a log when the vote was brought up. This conspiracy to use Everett just doesn't add up. Not to mention Everett has stated publicly that he has known since he was 19 he was going to run for Mayor. The all powerful Wade probably started this "conspiracy" when Ernest was 19, been saving him up in his back pocket all these years until he needed him. Conspiracy, no, bad luck for Rodney yes.

It doesn't fucking matter. There is a presumption of innocence whether you call it a charge or an accusation. Fuck sake. Stop arguing semantics. A charge is an accusation. The warrant is issued on probable cause. That its more likely than not that a crime was committed and the accused committed a crime. A jury will determine if the state can prove its case beyond a reasonable doubt.

One question still remains. While Rodney is ultimately responsible for his campaign, he supposedly had an experienced election law guy on his side. Did Sabo deliberately screwup or is he less than competent? As the OP notes, Rodney was very quick to jump on the validity of the signatures, so it's not a case of the issue arising as the deadline approached.

Phana poses a good question. Sabo was Wades pick for judge and lost. Also has or had been a Dem county committee member. Then Sabo is hired by Rodney to have Everett removed from the ballot because of obvious irregularities. Sabo then screws up. The question again, is Sabo incompetent or did he screw the case up because he owes Wade?

Rumor has it that a former Facebook/Troy Polio poster had a major meltdown and tried to pull his own Jihad at the Race Track gas station on 2nd ave and 105th street. When this mini "tree expert" seen Patrick Madden campaign signs in front of this store he pulled in took the sign and proceeded to threaten the people behind the counter waving his fist in the air. The police where call and I'm not sure if charges are eminent. I do know that a reporter for the TU is now in possession of the video tape. I sure hope this little fella is not placed in the same cell as Ernest. He may try to chop him down so to speak. This mini gadfly is having major meltdowns as of late. Sabo is a good attorney. The idea that he'd throw a case is ridiculous. He has a law license to think about. He was also a vocal supporter of Rodney's and is in deep doo-doo with Wade. Stop the conspiracy theories. They are ridiculous. 8:54 makes much more sense than anything.

By the way, you need probable cause for a warrant. That is, a preponderance of the evidence, not beyond a reasonable doubt.

A lawyer need not "throw" a case to do someone a favor, and to state that anyone who finds the situation is ridiculous or ludicrous should review Rensco political history. The alternative explanation is an excellent alternative, but again, I would expect either Sabo or campaign manager to be on the timing like white on rice. However, no one is infallible, and Bob's explanation does make more sense.

With due respect, a lawyer doesn't 'do a favor' for someone to screw over a client. Lawyers do mess up the statute of limitations, notice of claim time frames and other time limits. There is no grand conspiracy. If you knew Sabo, you'd know. If you knew Wade's relationship with McDonough, you'd also know that Eddie isn't going out of his way to help Wade. I understand it's fun to speculate but Sabo isn't getting into the weeds on this crap.

However, Mr. Wiltshire seems bound and determined to eliminate the last democratic power base in this county. I am not complaining, obviously...

Well I don't agree with Bob or Phana. If anyone has ever met or dealt with Sabo he will tell you he has never, can't and will never lose a case or make a mistake. Also, Bob from Brunswick stated "If you knew Wade's relationship with McDonough, you'd also know that Eddie isn't going out of his way to help Wade"? McDonough's job is due solely and only to Tom Wade. Now lets recap. Rodney who lied and said he had nothing to do with Dziemba's complaint on Ernest's petitions said today he was and his crew were "all hands on board" to have Ernest removed from the ballot. As far as the relationship between Rodney and Sabo, if anyone trusts either one they're a fool. One last thing about the high standards of lawyers. Sabo was shoved down Lou's throat by Wade in a part time job under Silverman in city hall. Lou under (good) advice from Silverman bounced him shortly after. You can change opinions but you can't change the facts.

You can't change the facts, but you can't create them either. Lou asked Sabo to be Corp. Counsel. Sabo would have had to step down as North Greenbush Town Judge because the Committee on Judicial conduct view the corp counsel as the counsel for the city and a town judge would be unable to practice in Turners Court. That prohibition would extend to the deputies as well. Therefore, they asked him to be a deputy corp counsel instead, although he couldn't practice before Turner.

He later resigned to run for Surrogate. Silverman mistrusted Sabo so much he asked him to be his treasurer for his ill-fated run for Police Court.
