FRENCH IMMUNIZED



On a very special episode of...



It looks like D.A. (disaster area?) Joel Abelove declined to obtain a waiver of immunity from Troy Police Sergeant Randall French before French's grand jury testimony. A grand jury that gathered to determine if French committed a crime.

The district attorney's unusual decision not to require the officer, Sgt. Randall French, to waive his immunity from prosecution means he cannot face criminal consequences for his conduct during the April 17 shooting incident.

Nothing to see here. Move it along, move it along.


So, French could never really be indicted. If he was indicted, he had immunity from any prosecution. If he was not indicted, he would not be prosecuted.

Once again, let us be clear: this is not about Sergeant French. We have no reason to doubt his version of events. This is about process. A process that has been abused by District Attorney Abelove  like an alter boy in a room full of randy priests.

Perhaps this is a new policy. It would certainly cut down on prosecutions and save money.

We can only assume that Abelove knew what he was doing. Since his other missteps had the stink of politics, perhaps this was a clumsy attempt to court popularity with the PBA.

In any event, Abelove's attempt to poke his thumb in Cuomo's eye over Executive Order 66 makes Order 66 (of questionable necessity) look more necessary than ever. Ah, the delicious irony. No wonder the other DA's didn't want this guy leading the charge against Cuomo's order.

 So, who's lining up to run in 2018?

This was not an attempt to court popularity with the PBA, Abelove is too arrogant for that. This was a stupid and arrogant end run around the AG and the Governor that will inevitably end Abeloves career once and for all.

Abelove may not be DA much longer. Allowing immunity for Sgt. French is clear misconduct, no DA has ever done anything similar. Abelove cannot face criminal or civil liability for discretionary decisions - but it is so over the top that the Governor may remove him. Next to impossible for AG to prosecute now. This however may only rebound against Sgt. French - likely that a Federal Civil rights case follows....

The problem with Joel's blunder is that the absence of an immunity waiver is so unheard of, and the presentation was so absurdly rushed, that it LOOKS like a coverup. It reeks of corruption and taints the police, even if they did nothing wrong. How is that fair? It's too bad Abelove can't stick to ruining his own reputation, instead of dragging a good cop down with him.

And despite the immunity, French could still be prosecuted in the federal system if the facts warranted. It would be unlikely, except thanks to the utterly incompetent way Joel handled this, there's a highbeam spotlight on the case. Now the AG, the BLM crowd and the media are out for blood. Great job, Joel.

Abelove is a dangerous disaster. Worse than D'Angelis. Ask any criminal lawyer in the Capital District of any political party.

The containing saga of the rogue DA. However the real news of the day is that both Mayor Madden and Mayor want to be Mantello seem to agree that the selection of the new Commissioner of Planning and Economic Development is a good one.

I really want to go to bat for Abelove, but he is sure making it difficult. I appreciate his willingness to take on the AG and Gov, but it sure creates at least an appearance of overzealousness. However, I believe Cuomo has enough on his personal legal plate to get too involved with this situation. As far as the BLM crowd and their useless sycophants, who gives a damn about their opinions?

Now a notice of claim has been filed naming Abelove. So it's not bad enough that he has turned the DA's office into a political tool to prosecute those on the other side while giving his republicans pals a free pass, it's not bad enough that Bill Chamberlains murderer still remains uncharged five months after he was brutally killed. Now the taxpayers are going to have to pay for his arrogance and incompetence. Enough!!!!!!

Six figures would actually be on the low side. Abelove however has "absolute immunity" from liability for decisions made as aprosecutor. Doesn't mean he can't face ethics charges or be removed by the Governor....

Absolute immunity? Do some research. Abelove can and probably will face criminal charges for his actions. Ethics complaint or removal from office are the least of his problems.

Given someone a immunity is something his lawyer requires before putting him on the stand. Its very common practice.

7:16 - No need for a lot of research, US Supreme Court has ruled several times that DAs have absolute immunity for decisions relating to prosecutions (See e.g. Imbler & Buclkey cases). Removal and/or ethics sanctions is where he may be hit.

Not at all common for Grand Jury. DA always (and I mean without exception) requires a signed waiver of immunity before allowing the subject of a presentation to testify because NY provides "transactional" immunization - so the witnesses cannot be indicted. The presentation was therefore a farce as Abelove's action guaranteed Sgt. French could not be charged.
