BETTER LATE THAN NEVER

Here's one from the 'better late than never' files. According to The Record, Jack Cox, owner of Jack's Auto Sales on River Street, was fined $81,000 by City Court Judge Chris Maier. The reason? Keeping a junked car on the property. We know, we never would have guessed.

Cox has to pay $1,000 a day for each day a vehicle was illegally stored on the property. This is just one battle in a very long war waged by the City of Troy and Cox for years. The City has, almost always, been in the right. When the Troy Polloi sides with Bob Mirch, the stars have aligned.

Of course, Cox will appeal. Such an appeal should go to one of the County Court Judges. Why they would reverse is beyond us. The pickup truck could not be reached for comment.

We don't care if Cox doesn't want to play by the rules like everyone else. He should just be ready to pay for breaking those rules.

In other news, Troy Police are investigating the alleged murder of an unarmed woodchuck at the Frear Park golf course during a golf tournament. According to witnesses, a manned golf cart pursued and murdered a woodchuck. Police are investigating allegations that the murder was committed by two off-duty City of Rensselaer police officers.

It is not known if alcohol was involved. A motive has not yet been determined but jealousy has not been ruled out. The woodchuck's identity has not been released pending notification of next of kin.

If the allegations are true, it is more than disturbing that two grown men, sworn to uphold the law, would intentional injure, let alone kill, an animal. If the allegations are proven, the officers should be dismissed from employment and prosecuted.

  3. I am hoping that prior to leveling this rather Draconian fine someone tried to reason with Jack. I understand that is generally an exercise in futility, but I hate to see any private businessman hammered to this extent.

    I can't imagine the mentality of people who enjoy killing or torturing harmless animals.

    9:46 you can't be serious! The garbage crews work at whatever pace they want. Once they're done with their route, they are done, whether they work 8 hours r not. Driving to the dump isn't considered work. The police only answer assigned calls during their 8 hour shift. Mostly domestic disputes. Nothing extra. Have you seen the way people drive in Troy? There's no fear of a ticket. The fireman spend most of their shift going to the market, reading the papers or on their cell phones. Unless someone calls in with chest pains and then 6 guys go for a ride around the block.

    Really? Both were guilty of murder 1. The worst got a deal from the DA and pled guilty to Manslaughter, and the jury aquitted of Murder 1 despite the testimony of the accomplice. Just like the Vega case, no "big winner" here, just more spin....

  39. a five year old could get a conviction, says the guy with the law degree from Google. as a lawyer, I can tell you that case was extremely difficult to prove beyond a reasonable doubt, but Andrew Botts did another hell of a job, as he has done at least twice in the recent past. if he lost, I would not have been surprised at all, but he pulled this one out, and good for the family. the only credit Joel should get is actually keeping Mr. Botts on his staff. and who the F cares if the DA and defense attorney had lunch together? this happens ALL THE TIME! we are legal adversaries, but we can manage to do our jobs while keeping good relationships with the other members of the bar. Its called being a mature adult, some commenters on this forum should try it once in a while.

    1. Well said, 2.56. Obviously, at least one member of the media had Heimroth not guilty. I have little knowledge of legal minutiae, hence rely on the verdict like most. Since Ahearn was formerly in the DA's office, it's hardly surprising the DA and he would have an occasional lunch, and if a good relationship facilitates a good bargain down the road, we all win.

    2:56 - if you have a law degree, you clearly no nothing about trying murder cases, which puts on on the same level as most of the DA staff in Rensselaer. Botts is doing a fine job for an inexperienced ADA, but he only managed a manslaughter conviction in the Vega case, and there was no way any reasonable person could believe that Vega meant to injure rather than kill when he strangled the victim and then set her on fire. When you give the main culprit a plea deal in exchange for his testimony and then only get a manslaugter conviction, it is also not a great victory. Hopefully Botts will get better, because while he doesn't really have enough experience to be trying homicides, he is the best Abelove has left. However, if this considered a great victory, it is time for some serious changes. Still a long time to the next election, but Abelove may soon face serious consequences for immunizing a GJ target.....

    Assuming the GOP boner-inducing rumors are true, Gordon can't be charged with official misconduct. He did not abuse his official position in obtaining the recording. An officer could be charged but not Gordon. It is also not tampering with evidence because it wasn't tampered with. It is not possession of stolen property because the owner was not deprived of any propert. There is also no inherent monetary value to the recording. Again, if it is stolen property, why not charge Lyons. The 1st Amendment does not shield reporters from crimes.

    Not quite true. Even though Gordon was not a government official, if he solicited or encouraged a government official to release the tapes he can be charged as an accomplice. If on the other hand, if he or Lyons were passive beneficiaries, neither can ( or at least should not) be charged. Personally, leaving aside the politics, fine with charging anyone who abused their government position to release private information. However, if deals were made to allow either one or more law enforcement officials to remain on the job in order to target political opponents - as a taxpayer I will be outraged. That would be the DA abusing his authority.....

    Yes, but the solicitation statute that is applicable is a violation and not a crime. Also, the applicable public misconduct statute is a misdemeanor so no Grand Jury would be necessary. Whatever Abelove concocts, it looks like this act, if it did occur, falls between the cracks. If Gordon did facilitate the reproduction of the recording, I wonder if he could be fired from his Board of Election job. Now, if I were a cop that made the recording, there are a number of statutes that could be applicable.

    Abelove may want to concentrate on hiring and keeping ADA's that can prosecute serious crimes. His own hires jump ship quickly.

    If acting in concert, a person charged with Official Misconduct would face an A misdemeanor. While this would not require the use of a Grand Jury, the law allows the presentation of misdemeanor cases and a Grand Jury can vote such charges. Possible advantages include using GJ subpoenas to obtain evidence and compel testimony. This is just a guess, as not sure what Abelove may be doing - should be interesting.
    BTW, "Prosecutorial misconduct" is not a crime, although it would not be surprising if we see claims of unethical conduct.

    The people in Troy that peddle rumors are the first to be indignant when one of their own is the subject of a rumor. Pathetic.

    So if you can establish Gordon did something, please step forward. If not, perhaps you should wait. Maybe Tutunjian or Crawley were involved in it as well. The people here have as much evidence against them as they do against Gordon.

    Unless the TU was totally off(see 9/2 article), there was a Grand Jury presentation, and the DA gave immunity to Colaneri with Gordon as the main target. However, even though Gordon was ready to surrender as he expected an indictment, that Grand Jury term has ended with no charges filed, So either they got a court order to extend the Grand Jury because they expect more evidence, or Abelove failed to indict the proverbial "ham sandwich".....

    I see the good ol' boys at the hero hut down at 6th and Federal got the warning from the 9-0 vote by the city council the other night about adopting the financial recommendations from the Audit they had done. While they all quivered in their Lazy Boys about losing the ambulance and the overtime they call their union president at his home in East Greenbush and told him not to go to his second job and get his ass down to city hall and take what ever they will give us. Can't wait to see what's in this contract. I bet it has some kind of guarantee not to touch the ambulances. TIME TO CUT THEIR OVERTIME BY 25%. Now you boys can start all your bullshit about how baby's will die and old people will be dead on corners if you non resident city employees lose a dime. Oh also we all know that 12 of you live in Troy so stop that BS also.

      To Every hose rolling hero out there: When this contract goes to a vote, just say no! A $3000 step increase over the course of 4 years is a joke especially since guys with 8 years and up are the only ones to benefit. No retro, it's like taking 4 0's. The city is trying to pull the wool over its employees eyes. It's time to wake up and realize Madden and Monica do not give a crap about its employees. Razzano should be ashamed of himself for even thinking this is a good deal.

    If you look at the proposed contract between The City and the UFA, you'll see that the people whose opinions on minimum manning and overtime matter disagree with you. So you need to contact City Hall and/or speak at a Council meeting to try and convince them that you are right and they are wrong.

    Or, you can continue to anonymously post half-truths, outright lies, and obsessive rants about the Troy Fire Department which probably help you self-medicate on some level in the short term, but is probably not in your best interest in the long term.

    Forever is a long time to hold a grudge. Don't be afraid to talk to a professional to work it out. I think you'll like the change of pace of your first thought of the day being something that makes you happy instead of the building on 6th Avenue.

I remember calling you out before and you went right to the Internet and looked for a story about a family that lost it all in a fire. Then you spun the story around to try and fear monger the readers. Well down at the Hero hut in your legends lazy boy please look up the story about Oswego Mayor laying off 20 heroes. I feel sorry for the 4 who think they have a job starting next week. They will be the first to go. Your department is single handedly responsible for the financial ruins the city is in as well as the blight that is taking over this once great city. As people now continue to leave Troy because of the taxes remember one thing. The firemen were the first to get the money and run. Best of luck.

  102. Clearly the contracts "negotiated" in the past are devastating. The minimum staffing and mandatory OT are killing the city. Some of this goes back 25 years, but I am still waiting for the arbitration result on that 10 yr service equals lifetime medical for the TPD. I've heard more from Fitzy on that than any of the alleged representatives of the taxpayers.

    Those of us who live here, who work in the private sector, are stocking up on the KY in anticipation of getting tax-raped again this year. City is gonna kill us, Library this Tuesday, & the County will hit us with their obligatory 1-2% increase. Many of us are trying to plan our exit strategies, but can't sell our houses for a decent price. They keep promoting, hiring, and spending at both the county & city. Tax breaks being given to former employers to build hotels, County Leg workers being paid tax dollars to run campaigns, Fire Chiefs getting OT, 5k to have a fucking Birthday party, etc. etc. it's just fucking nuts. Its got to stop, and stop quick! John Q. Public is a sponge that cannot soak up anymore govt. waste. Another 90k about to be added to the city nut for a OGS-Commissioner btw. Horse-shit-- We're screwed
